Question:

I recently had asked BOMA International a specific question wrt their FAQs PDF on the new 2010 standard, and

they referred me to yourselves as being a possible source of clarification.

The specific situation is as follows:

xx A multi-storey commercial office building with a single tenant occupying all 3 floors. There are no

lifts/elevators in the building, and only 1 set of enclosed stairs which are inaccessible at the close of

business day once the tenant locks the front door of the building. Are these enclosed stairs effectively

"private stairways" per #2 of the FAQ and BOMA standard for single tenancy multi-storey office buildings and

therefore to be included as part of the usable area; or are they "standard features" of the building and

therefore need to be excluded from the usable area?

I would appreciate your clarification and feedback if possible. Thank you for your help.

Answer:

If it is a single-tenant building, you could use the Gross Area Standard 2010, and lease based on the Exterior Gross Area, which would include everything other than void areas (ie would include these stairwells).
If you wanted to lease based on Rentable area, then you would need to calculate Rentable in accordance with the Office 2010 Standard. In this situation, the stairs as you've described would be a vertical penetration, and not part of Usable area.
